1 ACCEPTANCE OF TERMS

Your access to and use of www.driveroundnz.com ("the Website") is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website.

2 ADVICE

The contents of the Website do not constitute advice and should not be relied upon in making or refraining from making, any decision.

3 CHANGES TO WEBSITE

Driveroundnz.com reserves the right to:

3.1 change or remove (temporarily or permanently) the Website or any part of it without notice and you confirm that Driveroundnz.com shall not be liable to you for any such change or removal; and

3.2 change these Terms and Conditions at any time, and your continued use of the Website following any changes shall be deemed to be your acceptance of such change.

4 LINKS TO THIRD PARTY WEBSITES

The Website may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.

5 COPYRIGHT

5.1 All copyright, trade marks and all other intellectual property rights in the Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to Driveroundnz.com or otherwise used by Driveroundnz.com as permitted by law.

5.2 In accessing the Website you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Website for personal, non-commercial home use only.

6 DISCLAIMERS AND LIMITATION OF LIABILITY

6.1 The Website is provided on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

6.2 To the extent permitted by law, Driveroundnz.com will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website.

6.3 Driveroundnz.com makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.

7 INDEMNITY

You agree to indemnify and hold Driveroundnz.com and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Driveroundnz.com arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.

8 SEVERANCE

If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.


SELF GUIDED TOUR TERMS AND CONDITIONS

Payment and Cancellations - A detailed confirmation will be provided shortly after your booking that details the costs and timescales for payments.

At the time of booking a non refundable 20% reservation deposit will be processed. This covers deposits payable for the accommodation.

The remainder of the accommodation and itinerary is payable 1 month prior to the tour start date and is automatically processed using the credit card details you gave us for the reservation deposit.

If we have booked a vehicle on your behalf then details of this and your contract with the vehicle company will be sent to you as a PDF file.

30 days from the start date of the tour the cancellation fee is the full amount of the tour.

We are pleased to arrange internal flights, ferries and side trips such as Great Barrier Reef and Whitsunday Island cruises. Where the costs of these are payable upon booking we will inform you and process this when we book them on your behalf. Flights and ferries are normally non refundable items due to the policies of flight and ferry operators.

It is vital you take out good travel insurance to cover you in the event of a cancellation. We will be pleased to provide invoices for cancellations so that you can pass them on to your insurance company for a claim.

Breakdowns and Accommodation - As with any mechanical device they unfortunately break down. It is rare these days but should it happen you must call the emergency number provided to you by the vehicle rental company. Drive RoundNZ has no control over their procedures and so it is vital you call them and make arrangements for repairs/help.

If your journey is goign to be delayed and you won't make the accommodation that night then call the accommodation for that evening and let them know. Call or e-mail us and let us know the situaiton along with the best way of contacting you. We will do our best to rearrange the accommodation for you but where there is no longer availability we may need to book you into alternative accoommodation. In this event and where cancellations charges apply these costs must be paid by you and recovered from the vehicle rental company or insurance where possible.

Travel Insurance - It is VERY IMPORTANT that you obtain good quality full travel insurance policy for your trip. You should take advice as to the best policy but it should cover cancellation, medical costs including transportation to hospital (flying doctor costs for example), replacement vehicle cover (if a vehicle is written off, for example, and the driver/rider is injured you may wish to continue via another form of transport and repatriation in the event of serious injury or death. DriveRoundNz accepts no responsibility for a customer’s failure to arrange appropriate cover. We strongly recommend you cover yourself with travel insurance in case of accident and to ensure that if your personal circumstances change and you have to cancel your costs are covered.

Driving Areas - Travel on remote gravel roads can be extremely dangerous unless you are well prepared and know how to deal with difficult situations. Every year tourists find themselves in trouble and some even die due to lack of preparation and knowledge. If you intend to drive on remote gravel roads then you MUST inform us of your plans. You should check with your vehicle rental company if you intend to drive on any gravel roads on your trip. Also please be aware: New Zealand law prohibits the use of rental vehicles on the following roads: Tasman Valley Road (Mt Cook), Nevis Canyon Road (Otago), Skippers Canyon (Queenstown), Macetown Road (Queenstown), Ninety Mile Beach (Northland) and any unformed road (including any beach.)

What is Included - Please see the terms and conditions specific to the tour or rental you have booked.

What is not Included - Excluded from all prices given (unless stated specifically) are personal travel insurance, flights, visas (if applicable), pre-and post-tour accommodation, National Park entry and other tourist attractions, fuel, oils, additional request items such as luggage carriers, food, drink and souvenirs.

Driving License - For all rentals you must have a valid driving license entitling you to use the vehicle you are intending to hire. An international driving license is also required in non-English language countries, but is not sufficient in itself.

Special Requests - Please notify BikeRoundNZ of any special requests you may have at the time of booking (e.g., diet, disability). There may be additional charges for any such requests.

Accident - In the event of an accident (or theft), always report it to the police immediately, obtain a police report number, and notify the vehicle rental company and Drive RoundNZ so that we can help to make alternative accommodation arrangements if necessary.

Liability - DriveRoundNz, its Agents, Assigns and Contractors accept no responsibility for and shall not be liable in respect of any loss, damage, alterations, delays or changes arising from circumstances outside its or its Contractors' control, such as, but not solely, war or threat of war, riot, industrial dispute, civil strife, fire, adverse weather conditions, terrorist activity, natural and nuclear disaster, technical transport problems, computer malfunction, cancellation of scheduled or charter airlines, closure or congestion of airports or ports, or financial failure of Contractors. DriveRoundNz may act as information and booking resource for vetted suppliers. DriveRoundNz may not invoice you for rental vehicles and may simply pass on booking information on your behalf. Your contract is with the supplier directly and DriveRoundNz accepts no responsibility for and shall not be liable in respect of any loss or damage whatsoever.

Rental Contract
Where DriveRoundNz arranges your vehicle rental the legally binding contract for the rental will be between you and the rental company and not with DriveRoundNz.

Indemnity Release
By booking a rental, self guided tour or guided tour you agree that you understand and agree to the indemnity release detailed below which is between you (and any passengers) and RoundNZ.com atf the Osborne Trust T/A DriveRoundNz, it's directors, employees or agents (hereafter called The Company).

You must agree that you shall participate entirely at your own risk and that you, your successors, executors and administrators will release, indemnify and not instigate any claim, demand or expense against The Company for any personal injury, loss of life or damage to personal property suffered during or subsequent to events on the rental or tour.

You must acknowledge that any road whether sealed or unsealed, or any other venue upon which you travel, may have sandy or rocky surfaces with defects either hidden or exposed as is the nature of some roads.

You must agree to obey and observe all rules and directions given during a tour, whether given in writing or verbally by The Company and that The Company has the right to exclude you from any tour for non-adherence to any rule or direction given.

You must accept that you are permitted to take part in a tour on condition that you drive safely with due care and regard for other people and property.

You must acknowledge that driving a vehicle can be dangerous and that a vehicle rental or participation in a tour organised and promoted by The Company may expose you to the possibility of injury or death and further, you must acknowledge that the way other people may drive or act is outside the control of The Company.

You must acknowledge that there may be no, or inadequate facilities for treatment or transport of participants if participants are injured. You agree that you understand that travel insurance to cover all forms of personal injury, repatriation or costs in the event of death is essential and it is your responsibility to ensure you have appropriate cover.

You must agree that you have read and understood the indemnity release and agree that the participation in a tour whether guided or self guided is entirely at your own risk.
